Magistrates might in a few hours at most obtain the advice of the Crown Law Offices. It was therefore proposed to give Magistrates powers to dispose summarily of any offence not being capital or punishable by penal servitude for life or committed in Admiralty jurisdiction, if the convicting Magistrate thought that justice would be satisfied by six months imprisonment, with or without a fine of Fifty Dollars, and in certain crimes a flogging. At the instance however of their Honors the Judges, the larger list of exceptions contained in Section 5 was inserted while the Ordinance was before the Council.
